Port Waratah Coal Services - Members Take Action
Maritime Union of Australia members are poised to launch protected industrial action against Rio Tinto's subsidiary Port Waratah Coal Services (PWCS) in Newcastle after an impasse in negotiation because of the company's strident anti-union posture. Workers at Kooragang Island and Carrington have voted on the motion to take protected industrial action against PWCS, which has achieved strong support from the workers. "Rio Tinto and PWCS need to understand that Australia is not Bangladesh," said Ian Bray, the assistant secretary of the Maritime Union of Australia. "In Australia, we have standards established over many years to make sure workers' have a voice, a decent standard of living and, most important, a safety and health regime so their life and limbs are safeguarded." PWCS' anti-union proposals are seeking to undermine the safety and health of workers, tear up long-standing settlement procedure of contract issues, and radically change the scope of matters that can be arbitrated. Newcastle Branch Secretary Glen Williams "PWCS management is poisoning a long history of mutually beneficial good relations with its aggressive anti-worker, anti-union approach," said MUA Newcastle Branch Secretary Glen Williams. "It's trying to stick it to workers at every turn, refusing our reasonable claim that sick or injured workers should have a right to leave without pay and salary continuance insurance to deal with their illness. It just shows the PWCS - Rio attitude that workers are expendable parts." "PWCS has even gone so far as to try to remove the dispute procedure clause that has been in the agreement for many years which would allow PWCS do as it pleases even if a dispute resolution procedure is underway," added Williams. Talks between union members and PWCS have seen more than eight months of negotiations. The single bargaining unit representing workers comprises the Maritime Union of Australia, the Transport Workers Union, the Electrical Trade Union, and the Australian Manufacturing Workers Union. Mick Forbes, Branch Secretary of the Transport Workers' Union, Newcastle Branch, said the problem was that PWCS management was not willing to bargain in good faith. "PWCS is playing hardball -- they won't move on job security and proposed changes to the contractor's clause makes our members very nervous about what the company's real intentions are," Mr Forbes said. "We have enjoyed a long period of industrial harmony at PWCS through generations of enterprise bargaining agreements that continue to benefit both parties." "During the time PWCS has operated the coal loaders, we have seen a cooperative and consultative approach to industrial relations that has allowed PWCS to become the biggest bulk handling facility in the world. This has not happened by accident and our members are as much a part of the success of the company as management," Forbes added. Daniel Wallace, AMWU Organiser said: "This is union busting 101 and our members are determined that a few industrial relations extremists, who have been appointed to positions within the management of PWCS, will not destroy the flexibility and industrial harmony we have all worked so hard to achieve over many years." "PWCS are showing absolute contempt for their workforce and they need to come to the table ready to resolve these negotiations as matter of urgency," ETU organiser Russell Wilson said. "They have openly said that they will train non-skilled employees who do not have the requisite safety skills to do the job while industrial action is underway. They are determined to undermine their workers," Wilson added. In July last year, Glen Williams wrote to NSW Health Minister Jillian Skinner seeking an independent report about the cause of a cancer cluster at Kooragang Island. The MUA is still awaiting a response to the letter but it is understood that Hunter Valley Area Health Service is providing an interim report to the Minister. India: The Lost Boys Karma,16, has worked as a miner for over a year in India's northeastern state of Meghalaya, crawling deep inside a 'rat-hole' tunnel to dig coal for seven hours a day. "Inside it is very unstable. The smell is awful," he said sitting on a pile of coal. "It is so dirty, and it is difficult to move. You breathe in the coal and the dust. People get sick like this. There is no water to drink and it is so muddy. It is not nice at all." Child rights activists have reported that there are thousands of children like Karma working in Meghalaya's coal pits, because only those who are small in size are able fit in the claustrophobic tunnels. Many of them, like Karma, are believed to be from neighbouring Indian states, or from nearby Nepal and Bangladesh. Hasina Kharbhih has been fighting the exploitation of these children for several years through her NGO Impulse. She said agents working for mine owners help traffic children to the coal-rich Jaintia Hills district of Meghalaya. They promise impoverished parents high salaries in return for their children's work, but fail to mention the dangerous conditions they will be living in. The mines often flood without warning or cave in, trapping and killing workers. There is rarely any compensation for the victims. "If we die, we die," said Ram Kumar Rai, 40, a Nepalese miner in Jaintia Hills. "They just bury us here. If we live, we suffer and we can't earn. We rot here and die. People who have money, friends or family here, their body will be sent back to Nepal. And those who don’t have anyone, they will just throw their bodies here or there." Rai was recently trapped in a tunnel after a massive rock fell on him. He had severe pain in his back and chest but received no compensation or money for medical treatment from the mine owner. "When someone dies, they hide the body so no one will know. That way the owner does not pay compensation to the family. He doesn't pay a single cent," he said. There are several national laws in India that set labour and safety standards for mines, and ban children aged under 18 from working there. But the industry in Meghalaya is openly flouting these regulations because the state government has failed to implement these laws and punish offenders. Karma has been labouring here since he was 14. His family of seven moved to Jaintia Hills a few years ago from Assam, desperately searching for work. His father had just died of tuberculosis after spending a lifetime in Meghalaya's mines. "I would like to have the chance to study but then my brother would be the only one working and we cannot afford it. And if I try to do another job, the salary would be less. So do we eat or do I go to school?" Karma said. Karma works most days, using a pick-axe to remove coal from the walls of the tunnels. "When I first went in the rat-hole, I was so scared," he said. "I thought the roof would fall on me. My knees were all scratched, but after two weeks I got used to it." "There are boys who are nine to 10 years of age who are doing this work. Younger than that they cannot do it." Despite several reports by the media and child advocates, Ampareen Lyngdoh, Meghalaya's labour minister, said she had yet to see hard evidence of young labourers. "The mining owners were telling me that a child actually cannot pull out the coal from the mine," she said from her office in the state's capital, Shillong. "You need to verify the ages of these so-called children. We are a community which is very small built. If you looked at my face you would not know how old I am. I can challenge you on that. So I might look sweet 16 but my age is something else. "Every time we rescue these so-called children, they come to a medical officer and they manage to get a certificate which says they are above such and such age." Despite her reservations, Lyngdoh said the government is drafting the state's first ever mining policy so they can register all mine owners and set standards for what they can and cannot do. Child labour is banned under these guidelines but 'rat-hole' mining is not, which is why children are employed in the first place. Child rights activist Hasina Kharbhih is sceptical about the state government's sincerity in tackling child labour. "The political will has not been there because half of the mines are also owned by a lot of political leaders. So definitely there is a vested interest of the political leaders to actually ensure that you slow down the whole process of whatever complaint is coming," she said. "These people have no rights at all. A democratic country like India will not be developing and prospering through violation of rights. It is inhumane." Development is the act of improving quality of life and making sure everyone has the preference in what that life looks like. Political- The level and type of governance being practiced in the country. Environmental- This has to do with the natural appearance of the environment. Types of development Measuring development Studying development is about measuring how developed one country is compared to other countries, or to the same country in the past. Development measures how economically, socially, culturally or technologically advanced a country is. The two most important ways of measuring development are economic development and human development. Economic development is a measure of a country's wealth and how it is generated (for example agriculture is considered less economically advanced then banking). Human development measures the access the population has to wealth, jobs, education, nutrition, health, leisure and safety - as well as political and cultural freedom. Material elements, such as wealth and nutrition, are described as the standard of living. Health and leisure are often referred to as quality of life. These are used to examine whether a country is developed or not. Geographers use a series of development indicators to compare the development of one country to another. There is not a single way to calculate the level of development of a country What are development indicators Health. Does the population have access to medical care? Industry. What type of industry dominates? LEDCs focus on primary industries, such as farming, fishing and mining. MEDCs focus on secondary industries, such as manufacturing. The most advanced countries tend to focus more on tertiary or service industries, such as banking and information technology. Education. Do the population have access to education? Is it free? What level of education is available (ie primary, secondary or further/higher education)? To balance inaccuracies, indices tend to be an amalgamation of many different indicators. The United Nations Human Development Index (HDI) is a weighted mix of indices that show life expectancy, knowledge (adult literacy and education) and standard of living (GDP per capita). As Vietnam has a higher literacy rate and life expectancy than Pakistan, it has much higher HDI value even though it has a similar per capita GDP. HDI is measured between 0 and 1. The USA has an HDI of 0.994 whereas Kenya has an HDI of 0.474. As a country develops the quality of life and standard of living of people that live there improves. Someone's standard of living is their material wealth. Quality of life includes standard of living and other things that aren't easy to measure e.g. how safe they are or how nice their environment is. In general the higher a persons standard of living the higher their quality of life . But just because they have a high standard of living doesn’t mean they have a good quality of life. Different people in different parts of the world have different ideas about what an acceptable quality of life. Quality of life isn't the same as standard of living Causes of global inequalities Environmental factors affect how developed a country is: A poor climate: if a country has a poor climate (really hot or cold) they wont be able to grow much. This reduces the amount of food produced. This can lead to malnutrition in some countries leading to people having a low quality of life. People also have fewer crops to sell so less money to spend on goods and services. The government gets less money from taxes as less is sold and bought, meaning there is less to spend on developing the country. Poor farming land If the land in a country is steep or has poor soil then they wont produce a lot of food . This has the same affects as having a poor climate Limited water supplies Some countries don’t have a lot of water. This makes it hard for them to produce a lot of food. In computing, performance per watt is a measure of the energy efficiency of a particular computer architecture or computer hardware. Literally, it measures the rate of computation that can be delivered by a computer for every watt of power consumed. Performance (unlike watt) isn't an objective thing, it depends on what the computer is working on, but the Green500 list ranks the most efficient computers, according to one (possible) benchmark. System designers building parallel computers, such as Google's hardware, pick CPUs based on their (other than Green500) performance per watt of power, because the cost of powering the CPU outweighs the cost of the CPU itself. The performance and power consumption metrics used depend on the definition; reasonable measures of performance are FLOPS, MIPS, or the score for any performance benchmark. Several measures of power usage may be employed, depending on the purposes of the metric; for example, a metric might only consider the electrical power delivered to a machine directly, while another might include all power necessary to run a computer, such as cooling and monitoring systems. The power measurement is often the average power used while running the benchmark, but other measures of power usage may be employed (e.g. peak power, idle power). For example, the early UNIVAC I computer performed approximately 0.015 operations per watt-second (performing 1,905 operations per second (OPS), while consuming 125 kW). The Fujitsu FR-V VLIW/vector processor system on a chip in the 4 FR550 core variant released 2005 performs 51 Giga-OPS with 3 watts of power consumption resulting in 17 billion operations per watt-second. This is an improvement by over a trillion times in 54 years. Most of the power a computer uses is converted into heat, so a system that takes fewer watts to do a job will require less cooling to maintain a given operating temperature. Reduced cooling demands makes it easier to quiet a computer. Lower energy consumption can also make it less costly to run, and reduce the environmental impact of powering the computer (see green computing). If installed where there is limited climate control, a lower power computer will operate at a lower temperature, which may make it more reliable. In a climate controlled environment, reductions in direct power use may also create savings in climate control energy. Computing energy consumption is sometimes also measured by reporting the energy required to run a particular benchmark, for instance EEMBC EnergyBench. Energy consumption figures for a standard workload may make it easier to judge the effect of an improvement in energy efficiency. Performance (in operations/second) per watt can also be written as operations/watt-second, or operations/joule, since 1 watt = 1 joule/second.

Despite the fact that it has been officially in recession since the first quarter of 2017, and despite the persistent social tensions and stark inequalities, South Africa is still Africa’s leading economy, according to a 2016 ranking. As evidence, over half the electricity produced in sub-Saharan Africa is South African. With a young, English-speaking population and a wealth of mining resources, it has maintained its position in international trade and is positioned as a hub for the region and the entire continent. So, how do you go about setting up your company? What precautions should you take? What types of companies should you choose? Experts and entrepreneurs answer your questions. First of all, let’s take a quick look at the profitable sectors in the market, which is made up of 50 million inhabitants, only 12 million of whom have a standard of living comparable to our own. Delphine TILLY PETIT: I’d say that the agri-food sector is obviously one of the profitable sectors for demographic reasons; the sustainable living sector is also a profitable sector: South Africa is one of the countries, and Johannesburg is one of the capitals, that have signed the Agenda 2063 agreement, in other words a 50-year agreement; then there’s the digital sector as there’s a young population eager for technology and digital communication. Although the country has gone into recession, the mining and agricultural sectors are still profitable and recovering strongly after a fairly difficult 2016. Setting up a company in South Africa means choosing a region in which you’re going to establish yourself, and as we’ll see here, this is a strategic decision. Dominique Brunin If you’re looking to set up business in South Africa with a partner or on your own, you have to make a decision: do I set up in Johannesburg, do I set up in Cape Town, or do I possibly set up in Durban, on the Indian Ocean coast, depending on my products and access to my markets. If you’re in the agricultural and food business, you’re more likely to choose Cape Town or Durban; if you’re in the new technologies or the digital industry, you may choose Johannesburg, but every time you must decide and check on what is the best possible location for your business. Once you’ve chosen your location, your first task is then to sort out your visa so that you can invest locally and, as we’ll see, you’ll have to have a certain level of savings to hand. Laurent Padoux It’s extremely difficult to get a work visa in SA. When you’re an entrepreneur and you’re bringing an investment with you, you can have a visa as an investor. I think the current minimum investment is around 350 to 400,000 €. Once you’re over that hurdle, you’ll discover one of the advantages of South Africa Serge Boscher For an entrepreneur, it doesn’t take long to set up a company, which explains why we have around 200 French men and women who have already set up their company in South Africa and they employ several thousand people. If you follow the existing procedures to the letter, you’ll have your company up and running within a month. You have to negotiate 6 major hurdles: firstly, you have to register your company on the Companies and Intellectual Properties Commission (CIPC) website, which will cost you about 15€, then, with your CIPC certificate in hand, you have to open a local bank account. The next step is a visit to the SARS, the equivalent of France’s Bercy, followed by registration with the UIF, which is similar to France’s URSSAF; it’s the government authority that will oversee your future employees. At the same time, you have to register with the Benefits Office, which pays sick leave benefit resulting from an accident or illness. There are 4 different types of companies to choose from: the most common, the private LTD, requires no minimum capital. Serge Boscher You have private companies which are known as “private LTD”, the equivalent of the “sociétés anonymes” in France, and there are micro-enterprises as in France. It’s generally a modern economy. South Africa is the most modern economy on the African continent: it’s the most modern country from the point of view of quality of life and it’s also the most industrialised, so as far as the day-to-day workings of the business world are concerned, it’s not much different to France. Now, as we generally advise, get some help from, for example, the Franco-South African CCI, because it has a sound knowledge of the public authorities and of the private consultancy networks, lawyers, tax specialists, legal experts and communication companies.
